Since 95% of the people on this list have no idea of where this location is and the distance from Camp Brown Road to the house where this landowner thinks we're peeping, I've attached a screen shot from GoogleEarth that shows the house is 0.37 miles away. Even the best scope under ideal conditions would have a hard time discerning people inside the house. If the landowner had asked Mikey to move down the road so that he was looking at an angle toward the trees, that would have been fine, but to forbid Mikey and anyone else from exercising their rights on a public road just irritates the hell out of me.

Anyway, it might be a moot point as the numbers of snipe found today were well below what we observed yesterday so the flock may have moved to another location which may or may not be visible publicly.

I didn't say it's a fine idea to bird this location. What I said was my sense of the discussion was that birders "can bird" on the side of roads where there's a public right of way.

I agree with everyone that said we birders should be friendly and go out of our way to let people know what we're doing and ask permission to access private property. That being said, I don't think birders should let hostile people veto birding opportunities for others that are not on their property.

P.S.yes, I agree it must be weird to have someone look your way with binoculars or a scope and it's incumbent upon the birder to try to be as nice as possible.

I'm not in agreement with Jason that it has been concluded that it is a fine idea to go to this location. Legally, certainly within the limits that might vary based on the view of local law enforcement concerning vehicles stopped along roadways/shoulders. However, i do have a suggestion for those who will go:

If you are confronted by the angry/defensive property owner, you might ask him if there is anything you can do to help him out today. The first 1/2 dzn times he is asked, he might have the same reply "Get off my property, " but after that who knows, it may turn him around...

I think this was a good discussion and seems to have settled on the conclusion that birders can bird the side of the road...
