"Areas of the ocean that include up to 200 nautical miles from land, or, if less, half the distance to a neighboring country (i.e. Bahamas, Cuba or Greenland)" define the ABA area, not whether the birds are in state waters or not. The 200 miles is the also the jurisdiction of the U.S. Typically ,state waters only extend 3 miles from shore (for fishing puposes, etc.). However, the ABA does say that "Birds observed on or over an ocean are counted for the area having jurisdiction over the nearest land, if within 200 miles." So, if the location dot in eBird looks about 195 miles off the south tip of the Eastern Shore VA, the "nearest land" would be VA, not MD.

Europe or do they end half way across the pond or what?
