MD Osprey:

Some news sources are running this story with a stock photo of a 
Red-cockaded Woodpecker. I just looked at the video clip at the link, 
below, and the actual bird is a Downy.

So, the bird is not "endangered" but they still nabbed her for 
violating the MBTA. Still a bum deal, IMHO.
