Hi Elliot, 

Actually, the border funnies go back to early colonial times.  I believe
the charter for Virginia only granted land up to the river bank/mean high
tide line.  The borders were already fixed when the constitution was
ratified beginning in 1787.  When Congress retroceded the Virginia portion
of the District of Columbia well before the Civil War, everything on the
Virginia side of the Potomac up to the mean high water/tide line was
returned.
