The MOS has chartered the MD/DC Records Committee (MD/DCRC) to 
maintain The Official List of the Birds of Maryland. In the MD/DCRC 
Goals and Procedures document, here ...

... the MD/DCRC defines the pelagic boundaries as ...

4.2 Pelagic Boundaries
The Committee has adopted the following as the pelagic (open waters) 
boundaries of Maryland: Due east of the Maryland/Delaware/Atlantic 
Ocean border and due east of the Maryland/Virginia/Atlantic Ocean 
border, each for a distance of 200 nautical miles; and the border 
than connects those two points. The MD/DCRC considers all sightings 
within this pelagic zone to be associated with Worcester County, Maryland.


Some other states and organizations apply a "closest point of land" 
rule, but not the MD/DCRC.

The Chris Vogel sightings, reported on eBird, were at 36.841,-72.007 
which places the location approximately 174 nm southeast of the MD/VA 
boundary and approximately 191 nm east of Virginia Beach, clearly not 
in Maryland waters.
