I would like to offer a small clarification to Ellen's clarification. The term Critical Habitat as used in the context of the Federal Endangered Species Act is probably misnamed and is misunderstood by most people. Its usage does not refer to habitats, as we generally think of them, such as mixed hardwood forest, tidal salt marsh, etc. A Critical Habitat as used under the Act is a specific geographical area or areas where the protection of the listed species is considered to be essential for it's continued survival. Not all listed species have designated Critical Habitats. Critical Range might be a better term. Disclaimer: I am not familiar with the Maryland protected species laws. The usage of the term in regard to these laws may differ. Later...
