MDOsprey comes through again- this is the most helpful group of people I have ever come across. My next step will be to discuss with Mr. Fischbach the issues that you raise; getting information about what species have been present, the nature of the pond, whether there are deed restrictions, etc. should clarify the possible path forward. I believe that Mr. Fischbach has already hired a lawyer, but I don't know if it is one familiar with environmental law. However, it shows how serious he is in pursuing this.
