Sharp Shinned Winning

Ok here it is ... Majority has no doubts it SharpShinned . Noting Pencil thin legs, small head size, body shape , Rufous underparts extend down belly, notched tail , and Coopers would have more capped head appearance. 
This website was highly recommended and i had already found it prior to recommendation .Excellent website for comparison . I had clicked on the link for more photos and the pics of Sharpie looked just like mine.

I did go out for a couple hours this afternoon and did not see it . Although that doesnt surprise me cause the RedShouldereds do own this territory . 
I measured the stick that is on the Hawks left in the photo and it measured 8 inches from the limb the hawk is sitting on up to the tip . . Now the book says Sharpie start at 9 . Is this just body size or is it from top of head to tip of tail . Maybe dumb question but im not used to measureing birds. 
And OMG !!!! speaking of Redshouldereds and territory . It made me think of the Sharpshinned getting eaten by a Redshouldered  and reminded me of really aweful !! Utube videos i came across yesterday when doing my Coopers Sharpie research . I got to watch (and with disheartening feeling ) Eagles in British Columbia MOB a seagull to exhaustion and finally snatch out of the water and carry off .... A Hawk sitting on  a live giant snake on the ground , A Peregrine pluck feathers off a live BlueJay .... A Hawk with a very vocal Raven pinned to the ground. My point is i was a quite surprised that the Big birds do eat  Big birds ! 
Well enough of that . 
Back to the afternoon walk . I had my first  American Coot at the pond . With 12 Canada Geese and 5 Mallard. 
While walking along the wooded area i noticed a couple small trees have been chopped at with only one still in sight . My neighbor joined me and pointed out that a beaver lives in the pond and that he thought the beaver was the culprit . After a few minutes of standing i noticed that the bare area at the end of the pond i saw earlier actually had small white stumps sticking out of the ground . THE Beaver is chopping down all the small trees. . !!  I do think this is going to effect the bird habitat at the pond . I couldnt tell you how many birds hung out here. The Lodge was pointed out to me by other neighbors before  but i had never seen a beaver  . There are new trees floating in the water in front of the lodge . 
 
One more thing of interest . I found a beehive attached to a tree along the wooded area 
I have never seen a beehive of this shape before . Maybe someone can give some info about it . It hangs from the bottom of the branch and has layers of large flat round hives .
I do remember having many Cicada bee killers on the hill close by this area this summer. Perhaps its made by them . Wonder will they come back and do more work on it ? I think id want to avoid that area !!

Maybe someone can help with i.d. of my yard hawk today . I really believed from first sight it was a Sharp Shinned . And knew to run for the camera as photos usually help but hawks are so hard.  This would be a new yard bird if i get a positive i.d. i bet i have more unidentified hawk picts than those that are i.d."d ):
